Terms of Service

These Terms of Service ("Terms") govern your access to and use of ZipFencer (the "Service"), operated by ZipFencer ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. The Service

ZipFencer lets you build ZIP-code and polygon-based geographic targeting lists intended for use in advertising platforms such as Google Ads. The Service includes a web app, saved searches, exports, and related features.

2. Eligibility & account

You must be at least 18 years old and able to enter a binding contract. You are responsible for safeguarding your password and for any activity on your account.

3. Plans & billing

  • Demo: a no-login preview — one location, radius targeting, and a watermarked, truncated sample export. No account required.
  • Free account: one active location, radius targeting, full plain-text ZIP export, and local-only saved searches.
  • Starter: $24/month, billed monthly via Stripe. Up to 10 locations, all advanced targeting modes, ZIP-list import, Google Ads CSV import, manual editing, bulk CSV export, and shareable campaign links.
  • Pro: $49/month, billed monthly via Stripe. Everything in Starter plus custom polygon zones, cross-device cloud sync, intersection combine, and up to 25 locations.
  • Legacy Pro ($19/month): subscribers on our original $19/month plan keep that rate and Pro-suite capabilities (polygons, cloud sync, share links, intersection combine) at up to 10 locations — we do not auto-migrate legacy pricing. If a legacy subscriber cancels and later resubscribes, the legacy rate is no longer available and they re-enter at the then-current public pricing.

Prices and quotas may change with prospective notice. Continued use after a change constitutes acceptance.

4. Cancellation

You may cancel your subscription at any time from the dashboard or via the Stripe billing portal. Cancellation takes effect at the end of the current billing period, and you retain access until that date. See our Refund Policy for refund eligibility.

5. Acceptable use

You agree not to misuse the Service. Specifically you agree not to: scrape or bulk-extract data outside provided exports; resell exports or Service output; circumvent quotas; or use the Service for unlawful targeting, including any targeting that violates advertising-platform policies or applicable anti-discrimination laws (for example Fair Housing, ECOA, or similar). 6. Your content

You retain ownership of saved searches, polygon zones, campaign names, and any data you upload. You grant us a limited, non-exclusive license to host and process that content solely to operate the Service for you.

7. Our intellectual property

The Service, including its software, design, and documentation, is owned by ZipFencer and protected by intellectual-property laws. Except as expressly allowed, you may not copy, modify, or create derivative works.

8. Geographic data disclaimer

ZIP-code boundaries, polygon coverage, and other geographic data are provided "as is" for ad-targeting reference. They are not warranted as accurate for legal, tax, insurance, regulatory, emergency-services, or navigational use. You are responsible for verifying suitability for your use case.

9. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ZIPFENCER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE IS CAPPED AT THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless ZipFencer from claims arising out of your use of the Service or violation of these Terms.

12. Governing law & disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively through final, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Broward County, Florida. You and we waive any right to a jury trial and to participate in a class action. Either party may seek injunctive relief in court for intellectual-property infringement.

13. Changes to the Service or Terms

We may change the Service or these Terms at any time. Material changes will be announced in-app or by email. Continued use after changes take effect means you accept them.

14. Termination

We may suspend or terminate your access for breach of these Terms, suspected abuse, or if required by law. You may stop using the Service at any time and delete your account from the in-app settings page.
